General

    • By using the Red Soil Homeopathy Booking Platform, clients consent to these Terms and Conditions. These Terms and Conditions may change from time to time, so please revisit regularly.
    • The Red Soil Homeopathy service, including all content on its website, does not constitute medical advice and should not be relied upon as such. Users should seek professional medical advice from a qualified medical practitioner.
    • Red Soil Homeopathy is not an emergency service. In case of an emergency, contact a medical doctor, NHS 111, or emergency services at 999 in the UK, or emergency services within your own country of residence.
    • This website may include links to other 3rd party websites. These links are provided for information only and are not intended to signify that Jaina Shah of Red Soil Homeopathy endorses such websites and/or their content. Red Soil Homeopathy does not assume responsibility for the content or availability of any external sites and takes no responsibility for any harm, loss or damage suffered as a result of using the linked websites or as a result of using the information published on any of the pages of the linked websites.
    • Jaina Shah of Red Soil Homeopathy takes reasonable steps to ensure that website content is accurate and current; however, it makes no representations or warranties as to its completeness or accuracy. Users are responsible for verifying any information relied upon.
    • Red Soil Homeopathy will not be liable for any temporary unavailability of the website due to circumstances beyond its control.
    • Whilst every effort is made to ensure downloadable content is free from viruses, Red Soil Homeopathy cannot accept liability for damages resulting from virus infection.

Booking

    • Clients must be 18 years or older and possess and capacity to provide informed consent to use the service. By booking, the Client confirms they have the capacity to enter this agreement voluntarily and in good faith.
    • Upon receiving booking confirmation, a contract is established directly between the Client and Jaina Shah at Red Soil Homeopathy. The Client confirms they are acting as a genuine individual and not in any other capacity or on behalf of an agency, unless explicitly disclosed.
    • Clients are subject to and responsible for complying with all booking terms, including cancellation policies and other specific conditions.
    • Clients shall not send photos or images that include nudity or any private body parts, whether of children or adults.
    • Clients will not be instructed to discontinue any medication by Jaina Shah of Red Soil Homeopathy. The Client may be advised to consult with their GP for health checks if Jaina Shah of Red Soil Homeopathy deems it necessary. Any changes to the Clients prescribed medication remains the responsibility of the Client and their prescribing practitioner.
    • The Client consents to Jaina Shah of Red Soil Homeopathy retaining records and personal information provided during or prior to a consultation.

Payment and Cancellation Policy

    • Payment must be made at least 48 hours before the appointment. The Client may however, reschedule for an alternative date or time if before 48 hours of the scheduled appointment.
    • Cancellations or rescheduling of appointments made within 48 hours of the appointment, will incur the full cost of the consultation. If cancellations are made before 48 hours of the appointment, then a full refund will be made.
    • No refund will be provided if the entire length of the session is not utilised.

Consultations

    • All consultations are conducted online via Zoom. If for whatever reason, Zoom isn’t available, we will make every effort to find alternative methods (e.g. Skype, Google Meet).
    • Consultations will take place at the appointed time and for the scheduled duration. At Jaina Shah’s discretion, the consultation duration may be extended at no additional cost.
    • Consultations are confidential between the Client and Jaina Shah and will not be disclosed to 3rd parties without written consent, except as required by UK law.
    • The Client should ensure they are in a private space during the entirety of the consultation to maintain confidentiality.
    • Photos or videos may be requested to assist for assessment purposes. You have the right to decline. Recording consultations is not permitted unless all parties agree.
    • After the consultation, Jaina Shah will suggest a remedy/remedies with instructions for obtaining those remedies.
    • The consultation fee includes remedies to Clients within the UK. We will either send your remedy order to Ainsworths or Helios Pharmacies, for 1st class delivery to you. Remedies may also be available from Jaina Shah or can be purchased from any homeopathic pharmacy of your choice.
    • All Clients from outside the UK will be required to purchase the recommended remedies from a homeopathic pharmacy of their choice.

Data Protection

    • The Client’s personal data, including sensitive data as defined under the Data Protection Act 2018, will be processed in accordance with data protection laws.
    • Clients will provide Jaina Shah of Red Soil Homeopathy with personal details such as name, contact details, and any other relevant information necessary for the consultation.
    • Jaina Shah of Red Soil Homeopathy will only use personal data for consultation purposes and necessary follow-up.
    • If Jaina Shah of Red Soil Homeopathy becomes aware of any unauthorised access or breach of personal information, they will inform the Client as soon as possible.
    • Jaina Shah of Red Soil Homeopathy will not disclose Client information to 3rd parties without written permission unless required by law.
    • Jaina Shah of Red Soil Homeopathy will securely store and destroy all personal data seven years after the date of the last consultation for adults, 7 years after the 25th birthday of anyone under the age of 18, in accordance with UK data protection legislation.
    • Clients may request access to their personal data held by Jaina Shah of Red Soil Homeopathy, in accordance with the Data Protection Act 2018.
    • Although reasonable measures are taken to protect Client data, the privacy of information shared via internet platforms, emails, and telephone cannot be guaranteed.

Communications and Marketing

    • Your email will be added to our client list for updates on consultations, new and courses. You may unsubscribe at any time. We comply with the General Data Protection Regulation (GDPR) and will not share or sell your data to 3rd

Out of Hours and Emergencies

    • For urgent queries between regular appointments, support is available via video call or email using the Acute Consultation on the booking page. For emergencies, contact your Medical Practitioner pr emergency services immediately. Code of Conduct

    • Jaina Shah of Red Soil Homeopathy adheres to the Society of Homeopath’s Code of Ethics.

Limitation of Liability

    • Scope of Services: The healthcare services provided by Jaina Shah of Red Soil Homeopathy are intended to support and not replace any relationship that exists between a Client and their primary healthcare provider. The advice, diagnosis, treatment and recommendations provided are based on the Client’s specific health information and current best practices in healthcare. Jaina Shah of Red Soil Homeopathy shall not be liable for any adverse outcomes resulting from factors outside of their reasonable control, including but not limited to, incomplete disclosure of medical history, undetected conditions, or non-compliance with recommended treatments by the Client.
    • No Guarantee of Outcomes: Jaina Shah of Red Soil Homeopathy makes no guarantees or warranties regarding the outcomes of any medical treatments, recommendations or procedures. Homeopathy is not an exact science, and individual Client responses can vary. Jaina Shah of Red Soil Homeopathy disclaims any liability for outcomes resulting from the Client’s use of the advice provided unless due to proven gross negligence or wilful misconduct by Jaina Shah.
    • Limitation of Liability: To the fullest extent permitted by law, Jaina Shah of Red Soil Homeopathy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, physical harm, mental distress, lost wages, loss of earnings, or loss of data, even if advised of the possibility of such damages. In all cases, Jaina Shah’s liability for damages shall not exceed the fees paid by the Client for the specific serviced from which the claim arose.
    • Online and Virtual Care: For services provided online or other virtual methods, Jaina Shah of Red Soil Homeopathy assumes no liability for technical difficulties, interruptions, or other issues outside of their control. The Client acknowledges that online services are subject to the same limitations as any remote care service and agrees to contact emergency medical services if urgent care is needed during or after a virtual consultation.
    • Applicable Law and Jurisdiction: The Limitation of Liability clause shall be governed by the laws of England and Wales. Any disputes arising from healthcare services provided shall be subject to the exclusive jurisdiction of the courts in England and Wales.
